Terms of Service
Thank you for allowing TTLM, Inc. (DBA Terra Turf Landscape) the opportunity to provide your lawn and/or landscape service(s). Please take a moment and read through the following Terms of Service. You’re indicating that you have read and agree to the following Terms of Service when you hire us to provide your service.
24 Hour Guarantee / Complaints – If you are not 100% satisfied with a service please contact us within 24 hours and we will do everything we can to make it right! If possible, please send us pictures with a detailed description, so we know exactly how to resolve the issue quickly.
Definition of a “Man Hour” – A unit of production, equal to the work one person can produce in one hour.
Sprinkler Heads – In the event we damage a sprinkler head and the crew does not repair it immediately, please contact us within 24 hours so we can schedule the repairs at no cost to you.
Locks on Gates – Most clients provide us with their gate combination. However, if you choose not to, please be sure to unlock the gates on your service day. In the event you forget to unlock your gate(s), we will do our best to work you back into our schedule. To eliminate any issues, we recommend purchasing a Gold MasterLock that has 4 digits that simply line up.
Billing – We require a debit/credit card on file to provide any lawn/landscape service. (Large landscape installation projects can be paid with credit card OR check.) By providing us with your credit/debit card, you authorize us to auto charge your card for services rendered, immediately upon completion of the service/project. We accept Visa, MasterCard, Discover and American Express. In addition, you authorize us to use a third party to process payments, and consent to the disclosure to and storage of your payment information by such third party. We do not store your entire credit card information on, or within, our computers. If your credit card is declined, we will attempt processing until the balance is paid. It is your responsibility to keep your account, service address and credit card information current. We reserve the right to suspend or cancel service if your account is delinquent. You have the ability to log into your Client Portal anytime, to view your account details and billing history. In addition, if you would like us to email you a receipt, please contact us after the service has been provided and we will email you a copy. If you believe we made a billing error, please CONTACT US DIRECTLY AT (972-424-8873 or firstname.lastname@example.org ) so we can research the matter.
Marketing – You agree and give us permission to use exterior pictures of your home landscape/lawn on our website or other promotional materials. In addition, you consent to allowing us to place a small, disposable sign in your landscape. You are free to remove this sign anytime at your discretion or request we remove it.
Warranty– All work will be completed according to industry standards. All agreements contingent upon strikes, accidents or delay beyond the control of TTLM, Inc. We reserve the right to furnish substitute plants of equal or greater value in cases where designated plants are not available. We do not offer any extended warranty expressed or implied on any plants, flowers, trees, SOD, or any other service/product we offer beyond 30 days of the installation/service date.
Damage – In the event we accidentally damage your property, please let us know within 24 hours and allow us the opportunity to assess the damage and determine the cause. Based on the extent of damage, we will either arrange for professional repairs or completely replace the damaged item at no cost to you of course.
Rain – We follow a strict schedule and provide service(s) when it lightly rains. However, in the event of severe weather, our crews could be delayed, usually only 1 day at the most. Please provide 24 hours advanced notice if you think your landscape/lawn is too wet and would like us to skip or delay your service.
Sales Tax – All pricing is subject to sales tax required by the State of Texas. Please CLICK HERE for more information from the state comptroller.
Cancellations/Skips – Please contact us via email at: email@example.com or by phone (972-424-8873) at least 24 hours prior to your scheduled service date, during business hours, if you would like to cancel/skip a service. Cancellations for a Monday service must be received before 3:00pm, the previous Friday.
Project Estimates – A written estimate will be provided for all SOD, Drainage, Landscape projects and Christmas Light installations. It is your responsibility to review the estimate to ensure all materials and scope of work are correct. If you have any questions or are unclear on any items, please do not accept the estimate until you are in full agreement. Furthermore, verbal changes are not valid. All changes/corrections, etc that alter the original estimate, must be agreed to by both parties in email/writing. A change order will be created and sent for your acceptance before the change will take effect. Your acceptance is demonstrated by either clicking on the red "Accept Proposal" (Preferred method) at the bottom of the estimate OR by providing us with a 50% deposit.
Return/Refund Policy – Lawn Mowing, Landscape Cleanups, Flowers, Mulch, Aeration: We hope you are extremely happy with each service you receive. In the event you are not happy, please let us know right away, so we make every attempt to correct/resolve the issue. If we are unable to resolve the issue, we reserve the right, at our discretion, to either credit your Terra Turf account (to be used within the same calendar year), or issue a refund to the same payment method of the initial transaction. Landscape Projects, SOD, Drainage, Christmas Lights: All necessary materials are ordered and purchased as soon as we receive your accepted estimate. In addition, we also reserve your spot on our schedule. If you decide you would like to cancel your project, please let us know right away, so we can remove you from our schedule and attempt to cancel the order with our vendor(s). Your deposit will not be refunded. However, we will allow you to use the deposit, less any amount not refunded by our vendor, within the same calendar year that it was paid, towards another project or service(s).
Communication – You agree and consent to receive all communication electronically unless, at our sole discretion, we deem otherwise. It is your responsibility to open and view all communication that we deliver to you via the email address and/or cell phone number you provided when setting up your account. Furthermore, it is your responsibility to maintain up to date contact information for your account. Electronic communication shall be deemed to be received by you upon delivery to your email and/or text message. We use advanced CRM software that allows us to track successful receipt of opened emails to ensure timely interaction. In addition, all incoming and outgoing calls are recorded to achieve the highest level of accuracy, as well as for quality and training purposes. You agree to these terms when you accept the Terms of Service and/or hire us for any service/project, regardless of your actual physical location at the time of the recorded communication.
Changes/Updates To Terms Of Service – We have the right, in our sole and absolute discretion, to change, modify, or amend any portion of these Terms Of Service at any time by posting notification here or otherwise communicating the notification to you. A current copy of our Terms of Service will always be shown publicly here, on our website. If you ever disagree with our Terms of Service, you should terminate using our service and cancel your account immediately, by notifying us by phone (972-424-8873) or email at firstname.lastname@example.org and request a cancellation confirmation.
