Terms of Service

Please read these terms carefully. By engaging our services, you acknowledge that you have read, understand, and agree to the terms below.

I. Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Client,” “you,” or “your”) and Terra Turf Landscape Management, Inc., a Texas corporation (“Terra Turf,” “TTLM,” “Company,” “we,” “us,” or “our”).

These Terms govern all lawn, landscape, irrigation, cleanup, enhancement, and related services provided by Terra Turf, whether authorized by written agreement, proposal, estimate, invoice, electronic acceptance, or verbal approval.

By requesting, approving, or allowing Terra Turf to perform services at your property, you acknowledge that you have read, understand, and agree to be bound by these Terms and our Privacy Policy.

II. Scope of Services

Terra Turf provides professional landscaping services, including but not limited to:

  • Lawn mowing and maintenance
  • Landscape cleanups
  • Monthly cleanups
  • Fertilization and weed control
  • Seasonal services
  • Irrigation inspection and repair
  • Mulch, sod, and landscape enhancements
  • Storm debris removal
  • Commercial and residential landscape maintenance

Services are performed according to the agreed scope, schedule, and pricing. Terra Turf reserves the right to adjust service methods, staffing, routes, and scheduling as necessary to operate efficiently.

III. Property Access & Client Responsibilities

Client is responsible for providing safe, clear, and unobstructed access to all service areas on scheduled service days.

  • Gates must be unlocked or access codes provided.
  • Missed service due to locked gates, unsecured pets, blocked areas, or unsafe conditions is not guaranteed to be rescheduled and may be billed.
  • A $15 revisit fee may apply if a return trip is requested and crews must be rerouted.
  • Client must secure pets and remove or relocate personal items (including toys, hoses, furniture, decorations, and equipment) from service areas prior to service if Client believes there could be any risk of interference, damage, or safety concerns during our visit. Terra Turf is not responsible for damage to personal property or for pets that escape due to unsecured access or items left in service areas.

IV. Weather, Scheduling & Delays

Terra Turf follows a strict service schedule and does not suspend service due to light rain. In the event of severe weather, service may be delayed—typically no more than one (1) business day.

If Client believes the property is too wet and wishes to skip service, Terra Turf must be notified at least 24 hours prior to the scheduled service day during normal business hours.

Terra Turf is not liable for delays caused by weather, labor availability, equipment failure, or events beyond its control.

Your scheduled service day and/or arrival window is our goal; however, due to weather conditions or other circumstances beyond our control—including but not limited to traffic delays, equipment or vehicle breakdowns, crew availability, vendor or property access issues, or other unforeseen operational factors—service may occasionally be completed on an alternate or following business day. We will make reasonable efforts to provide advance notice whenever possible.

V. Service Standards & Satisfaction Guarantee

If Client is not fully satisfied with a service or believes service was missed, Client must notify Terra Turf within 24 hours of service completion.

Clients are encouraged to provide a detailed description and photos, if possible, to allow issues to be resolved efficiently.

After 24 hours, services are deemed completed and accepted.

A. Definition of a “Man Hour”
A “man hour” is defined as the amount of work one individual can perform in one hour.

VI. Irrigation, Lighting & Equipment Disclaimer

A. Sprinkler Systems

Terra Turf is not responsible for pre-existing irrigation defects, shallow lines, or improperly installed systems. If damage occurs and is not repaired immediately, Client must notify Terra Turf within 24 hours to be eligible for review and possible repair at no cost.

B. Low-Voltage Lighting

Most low-voltage lighting systems (including Malibu-style lights) are improperly installed or constructed of brittle materials. Terra Turf does not assume responsibility for damage to low-voltage lighting systems.

VII. Billing, Payments & Card-on-File Requirement

A. Required Card on File

For all routine and recurring services, including but not limited to lawn mowing, monthly cleanups, fertilization and weed control, seasonal services, and ongoing maintenance, Client is required to maintain a valid credit or debit card on file at all times.

B. Removal or Expiration of Card

If the card on file is removed, expires, or becomes invalid for any reason, services will be automatically paused until a valid payment method is provided.

Terra Turf is not responsible for missed services, route changes, or scheduling delays caused by a paused account.

C. Payment Authorization

By providing a payment method, Client authorizes Terra Turf to automatically charge the card on file for services rendered in accordance with the agreed pricing and schedule.

Accepted payment methods include Visa, MasterCard, Discover, and American Express. Client authorizes the use of a third-party payment processor and consents to the disclosure and secure storage of payment information by such provider. Terra Turf does not store full card numbers on its internal systems.

Clients may access their Client Portal at any time to view account details and billing history. Receipts are available by email upon request.

D. Service Rate Adjustments

Terra Turf Landscape Management reserves the right to adjust pricing periodically due to increases in labor, fuel, material costs, or other operational expenses. Clients will receive no less than thirty (30) days written notice prior to any pricing adjustment.

VIII. Late Payments, Declined Payments & Collections

  • Payment is due as stated on the invoice or agreement.
  • Past-due balances may accrue interest at 1.5% per month (18% annually) or the maximum rate allowed under Texas law, whichever is less.
  • A $35 declined credit card or returned payment fee will be assessed per occurrence.
  • Terra Turf may reattempt declined payments without further authorization.
  • Repeated declined payments may require prepayment or service suspension.

Accounts unpaid after 30 days may be referred to collections or legal action. Client agrees to pay all reasonable collection costs, including attorney’s fees, court costs, filing fees, and administrative fees as permitted by Texas law.

Terra Turf reserves the right to suspend or terminate services for nonpayment.

IX. Lien Rights (Residential, Commercial & HOA Properties)

To the fullest extent permitted by Texas law, including the Texas Property Code, Terra Turf expressly reserves the right to file and enforce mechanic’s and materialman’s liens for unpaid labor, services, materials, or improvements.

This includes, without limitation:

  • Residential properties
  • Commercial properties
  • HOA and multi-family properties

Client agrees to be responsible for lien filing fees, release fees, and associated legal or administrative costs to the extent permitted by law.

By requesting, approving, or authorizing services, Client represents and warrants that they have full authority to do so, including (if applicable) the approval and consent of any spouse, co-owner, or other party with an ownership interest in the property, or that Client is an authorized agent with authority to bind the property and all owners to these Terms of Service.

X. Photography, Video & Marketing Use

Client grants Terra Turf an irrevocable, royalty-free, perpetual right to photograph and video record the exterior of Client’s property and completed work before, during, and after services.

Images may be used for marketing, advertising, website content, social media, proposals, portfolios, and internal training. No personally identifying information will be intentionally included. No compensation is owed.

Clients wishing to opt out must notify Terra Turf in writing prior to service.

XI. Warranty & Living Materials Disclaimer

All work will be completed in a professional, workmanlike manner consistent with industry standards.

No warranties—express or implied—are provided on plants, flowers, trees, sod, or other living materials beyond thirty (30) days, unless expressly stated otherwise in a written contract, as such materials are subject to environmental, soil, irrigation, weather, and site conditions beyond Terra Turf’s control.

XII. Property Damage

If property damage occurs, Client must notify Terra Turf within 24 hours and allow Terra Turf the opportunity to inspect and assess the issue. Based on findings, Terra Turf will arrange repair or replacement as appropriate.

XIII. Sales Tax

All pricing is subject to applicable Texas sales tax as required by law. Additional information is available from the Texas Comptroller.

XIV. Cancellations & Skips

To cancel or skip a scheduled service, Client must notify Terra Turf by phone (972-424-8873) or email (office@terraturf.com) at least 24 hours prior to the service date during business hours.

Cancellations for Monday services must be received by 3:00 p.m. the preceding Friday.

XV. Independent Contractor Status

Terra Turf is an independent contractor. Nothing in these Terms creates an employment, partnership, or joint-venture relationship.

XVI. Governing Law & Venue

These Terms are governed by the laws of the State of Texas, with exclusive venue in Collin County, Texas.

XVII. Severability & Entire Agreement

If any provision is found unenforceable, the remaining provisions remain in full force and effect. These Terms constitute the entire agreement unless superseded by a written agreement signed by both parties.

XVIII. Changes to Terms of Service

Terra Turf reserves the right to modify these Terms at any time. A current version will always be available on our website.

If Client does not agree to the Terms at any time, Client must discontinue services and request cancellation in writing. Confirmation will be provided upon request.
